TOPTICK LLC & TrueTerms.IO: TERMS, CONDITIONS & USER AGREEMENT

By using TopTick or TrueTerms (referred to as "the Services" or "the Site"), you are agreeing to the following Terms, Conditions, and User Agreement ("the Terms"). These Terms form a legally binding contract between you and TopTick, and they apply to all users, including Sellers, Selling Agents, Buyers, Buying Agents, and any other registered or unregistered users.

Your continued use of the Services after any changes to these Terms means you accept the new terms. These Terms also incorporate the provisions of the Privacy Policy.

Platform Overview

Powered by TopTick: TrueTerms is powered by TopTick. The terms and conditions outlined here apply equally to both platforms. All users are subject to the same rules.

Acceptance of Terms: By accessing the Site, you agree to these Terms. Some services may have additional terms, which will be presented to you. If there is a conflict, the additional terms will take precedence for that specific service.

General Disclaimer of Warranties

TopTick / TrueTerms provides its services "as is" and makes no warranties or representations regarding:

The accuracy, legality, or decency of any content on the Services.

Any claims, expenses, damages, or liabilities that may arise from using the Services.

Any recommendations for services or products, including homes listed by Sellers.

TopTick / TrueTerms is a facilitator for the Purchase and Sale Agreement. We do not offer any warranties about the properties listed on the Services.

Specific Property Disclaimer

TopTick / TrueTerms is not responsible for the quality, legality, or any other aspect of a property listed on the Site. Our role is limited to:

Facilitating Connections: We connect Buyers with Sellers and their agents.

Aggregating Offers: We provide a platform to collect, summarize, and present offer details in a way that allows the Seller and their agent to compare them.

We do not make any representations or warranties about a specific property's suitability, quality, or compliance with any laws.

User Responsibility: Buyers are responsible for their own due diligence to determine if a home is suitable for their needs.

Information Accuracy: TopTick / TrueTerms is not responsible for ensuring that the information provided by a Seller, Buyer, or their agents is accurate or up-to-date.

Sales Period & Optimized Offer Pool

Sales Period: This is the time when all parties agree to use TopTick / TrueTerms to receive offers.

Optimized Offer Pool: This refers to the systematic collection of all valid offers submitted by Buyers and their agents

Post-Transaction Disclaimer

TopTick / TrueTerms is not responsible for the actions or conduct of the parties after offers have been submitted.

Our Role: We only connect buyers and sellers and provide a platform to aggregate and present offer details. Any ranking of offers is not a recommendation to the Seller or their agent.

Not a Real Estate Agent: TopTick / TrueTerms is not a real estate agent. We do not directly sell the property, and the responsibility for disclosures and warranties remains with the Seller and their agent.

Commitment to Sale: All Sellers and Buyers agree to make reasonable efforts to complete the sale if an acceptable offer is made. Users are responsible for all applicable government fees and taxes.

Changes to Terms

TopTick / TrueTerms reserves the right to modify these Terms at any time without prior notice. The updated Terms will be posted on the Site, and the "Last Updated Date" will be changed. By continuing to use the Site after any modifications, you agree to be bound by the new Terms. If you do not agree to the modified Terms, you must stop using the Site and its services.
